One of four defendants in grave marker theft case sentenced

One of the four people charged in the disappearance of grave markers and historical site markers was sentenced Monday in Franklin County District Court.

43-year-old Brandon Smith of Hampton recently entered a guilty plea to the charges of first degree theft and first degree criminal mischief.  Smith was sentenced Monday for up to 10-years in prison on each charge, with the sentences to run consecutively, meaning Smith’s sentence is actually 20-years.

A charge of tampering with a witness against Smith was dismissed.

The other three defendants, Rachel Card of Hampton, Lauren Johnson of Dumont, and Joshua Sellers of Manly, have all entered not guilty pleas to the same original charges filed against Smith, and their trials are set to begin in mid-July.

And in a related story, a charge of tampering with a witness against 28-year-old Stephanie Carstens of Hampton, was also dismissed by the district court.  Carstens had been charged in April for her alleged involvement working with Smith before his trial was to begin.
