Several Iowa Counties to Weigh In on Pipeline Court Case

Several counties in Iowa this week are set to discuss whether to contribute funds toward an amicus brief in the Couser versus Shelby County case — a legal dispute over local regulation of the proposed Summit Carbon Solutions carbon dioxide pipeline. The case centers on whether counties have authority to enact their own safety and zoning rules for the pipeline or if those powers are preempted by federal and state law.

Grundy County Supervisors will take up the issue at their meeting Monday morning. Wright County’s board will also discuss it during their, and Franklin County supervisors have the topic on their Monday agenda as well.

The brief is being filed on behalf of the Iowa State Association of Counties.
